Özet
Bazı hallerde bir kişinin, meydana gelen zarardan sorumluluğu birden fazla hukuki sebebe dayanabilir. Türk Borçlar Kanunu madde 60 hükmü, bu soruna yönelik bir çözüm önerisi getirmekte ancak bu öneri, Medeni Usul Hukuku’nun temel ilkelerinden biri olan hâkimin hukuku re’sen uygulaması ilkesi ile çelişmektedir. Bu çelişkinin öncelikli sebebi Türk Borçlar Kanunu madde 60 hükmünde yer alan “zarar gören aksini istemedikçe” ifadesidir. Bu cümle, zarar gören tarafa uyuşmazlığı çözecek hukuk kuralını belirleme yetkisi sunmaktadır. Oysaki Hukuk Muhakemeleri Kanunu madde 33 hükmü uyarınca olaya uygulanacak doğru hukuk kuralını tespit edecek yegâne kişi hâkimdir, hâkim görevini yaparken tarafların görüşleriyle bağlı değildir. In some cases, the liability of a person for damage may depend on multiple legal grounds. The provision of Article 60 of the Turkish Code of Obligations introduces a solution to this problem, but this proposal is in conflict with the IuraNovit Curia principle, which is one of the basic principles of the Civil Procedure Law. The primary reason for this strain is the expression of the article 60 of Turkish Code of Obligation: “unless damaged party desired otherwise “. This sentence gives the injured party the power to determine the rule of law that will resolve the dispute. However, in accordance with the provision of article 33 of the Turkish Civil Procedure Law, the only person who can determine the right rule to be applied to the case is the judge, he is not tied to the views of the parties when performing his duties. The aim of our work is to interpret Article 60 of the Turkish Code of Obligations in the framework of the Turkish Code of Civil Procedure’s Iura Novit Curia principle and to bring a solution to the problem of priority implementation in this respect.…
