Abstract: Many deaths occured during the First World War and especially the Second World War. Necessity of those who cause these deaths to be tried has become to the fore in public opinion. The International Military Tribunal in Nuremberg and the International Military Tribunal in Tokyo are established to trial these persons by the states that the winners of the war, which functioning similarly. Years later, the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda are established by the United Nations Security Council, which functioning similarly. These tribunals have served as ad hoc tribunals. Meantime, some drawbacks and violations of criminal law principles of ad hoc tribunals have appeared. The idea of establishing a permanent international criminal court to eliminate these drawbacks and violations has become widespread. As a result, the International Criminal Court is established. The International Criminal Court can be considered successful in eliminating problematic aspects of ad hoc tribunals. However, the International Criminal Court should keep its relationship with the United Nations Security Council at level of cooperation and not act as if there is an organic link with the Council. Otherwise, the International Criminal Court may also face criticism raised against ad hoc tribunals.…
