In a detailed fragment(184) by Paulus on verbal obligations, the question is again brought up, by way of an example, whether “a ship” ceases to be “the ship” if it was taken apart and then put back together. It is held that the owner’s intention is decisive: if the ship was taken apart so as to use the planks elsewhere, the ship would be deemed to have been destroyed, notwithstanding that it may have been brought together again. Conversely, however, if the planks were removed simply for repairs, the original ship will not be considered as destroyed(185).…
