Netflix is a digital platform which is accessed via internet. It attains cinematographic works on which is available in its platform by two ways. Firstly, some of these works, named as “Netflix Original”, are exclusive to its platform; secondly, Netflix signs a copyright agreement with owners of copyright about the financial rights upon the work, especially communication to public. Through these agreements, authors or owners transfer their copyright on their works. Generally, foreign element is found in these agreements; therefore, we must decide which applicable law is applied to these agreements. The aim of this study is to identify the law which should be applied to copyright agreements within Netflix and filmmakers. While doing this identification, first of all, the Notion of cinematographic work and copyright agreement are examined. Finally, applicable law to the agreement is tried to be determined.…
