Gafta Tahkim ve Arabuluculuk Kurallarına Genel Bir Bakış: ÖZ

Hububat ve Yem Ticareti Birliği (Grain and Feed Trade Association – GAFTA) 100 ülkede 1900’ün üzerinde üyesi bulunan ve sektöründe uluslararası ticareti geliştirip üyelere fayda sağlama amacına matuf bir kuruluştur. Bu doğrultuda, hububat ve yem ticaretinde edinilen tecrübeye dayalı, özellikle çokça ihracat-ithalat yapan ülkelere ve ticarete yönelik süreçlere yönelik örnek sözleşmeler oluşturan GAFTA, aynı zamanda sektörün özelliklerine uygun uyuşmazlık çözümünü amaçlayan tahkim ve arabuluculuk hizmetlerini de ihtiva etmektedir. Türkiye hububat ve yem ithalat-ihracatında dünyanın önde gelen ülkelerinden biri konumundadır. Bu doğrultuda GAFTA sözleşmeleri ve uyuşmazlık çözüm metotlarının ülkemizde yaygınlaşması hem ihracatçılarımızın hem de ithalatçılarımızın, küresel anlamda daha güvenli bir ticaret pratiğine kavuşmasına yardımcı olacaktır. GAFTA tahkiminin yetkilendirilmesi örnek sözleşmelerde tahkim şartı ile veya 125 ve 126 numaralı sözleşmelere yapılan atıflar ile olabileceği gibi tarafların daha sonrasında ya da sözleşmede bu konuda mutabakata varmaları ile de olabilecektir. Arabuluculuk kurallarını ise128 numaralı sözleşme ihtiva etmektedir. Bu örnek

The Grain and Feed Trade Association (GAFTA), with over 1,900 members across 100 countries, is an organization dedicated to fostering international trade within its sector, aiming to benefit its members. In line with this objective, GAFTA develops model contracts specifically tailored to the processes involved in grain and feed trade, especially for countries with substantial import-export activities. Türkiye stands as one of the world’s leading countries in grain and feed imports and exports. Accordingly, the widespread adoption of GAFTA contracts and dispute resolution methods in Türkiye would help both our exporters and importers engage in a more secure trade practice on a global scale. The authorization of GAFTA arbitration may be established through an arbitration clause in the model contracts, references to model contracts No. 125 and 126, or by a mutual agreement between the parties, either subsequently or within the contract. Mediation rules, on the other hand, are incorporated in model contract No. 128. These model contracts, like the substantive model contracts, are procedural law contracts shaped to meet the needs of the sector and contain specific provisions.
