Abstract
The climate crisis poses a significant threat that has already impacted millions of lives and has the potential to disrupt societies and ecosystems globally. Despite decades of international efforts and commitments outlined in climate treaties and protocols, these initiatives have not created meaningful change within the existing economic framework. The climate crisis jeopardizes several human rights, such as the right to life and the right to health. While international agreements play a crucial role, human rights obligations can serve as mechanisms compelling states to address climate change. Many countries have incorporated climate-related provisions into their constitutions or domestic legal systems, while others rely on constitutional environmental rights and the state’s duty to protect fundamental rights and freedoms. In this context, climate lawsuits are being filed in numerous countries with the primary objective of compelling states to take decisive measures to prevent climate crisis and address the human rights violations arising from climate change. Türkiye, too, faces growing challenges linked to the climate crisis and anticipates escalating risks in the near future. While Türkiye is a party to climate agreements and has formulated climate action plans, these efforts lack sufficiently ambitious targets and remain ineffective due to existing economic policies.
