ABSTRACT…

The Agreement on the Promotion, Protection and Guarantee of Investments among the Member States of the Organization of Islamic Cooperation includes two provisions regarding the resolution of disputes. These are Articles 16 and 17 of the agreement. In this study, the theoretical and practical evaluation of these two provisions will be made. After the explanation of the relevant provisions, the decisions of Al Warraq v. Indonesia and Itisaluna v. Iraq, which contain important evaluations in terms of the interpretation of these provisions of the agreement, will be included. The provisions of the agreement regarding dispute resolution methods will be interpreted in the light of the evaluations of Tribunal in these cases.…
