Abstract…

The most important tasks of the press are to inform society on important matters and to affect public opinion by criticism and evaluation. Due to these important tasks press is indispensable in democratic societies and it benefits from “the freedom to report”. The limit to this freedom, i.e. freedom of the press, is the violation of personality rights and accordingly, violation of privacy. The important point here is to determine the fine line between the freedom of the press and the violation of privacy which may occur while benefiting from freedom of the press. It is a difficult task to determine which publication of the media violates privacy. This issue has frequently been the subject to the European Court of Human Rights judgments. The court has developed case law on this issue and updated its case-law according to the concrete dispute. The purpose of this study is to determine the lessons for Turkish law from the case law of the European Court of Human Rights in violation of the right to privacy by media.
