Recently, a public debate has erupted on the use of caricatures/comics on internet, and social media and its relation to copyrights of the caricaturists. This debate was triggered by a series of legal actions taken by the caricaturists against those who allegedly used copyrighted works illegally. Unlike its EU and USA counterparts, the Law on Intellectual and Artistic Works (LIAW) no 5846 offers a very protective and rather archaic regime for the copyright owners against the newly emerging means of usage/communication by third parties via memes. In this work, where a caricature falls under the LIAW, what rights are attributed to caricaturist, what exemptions are provided by the Law to third parties against the copyright owners and what legal actions can be taken in case of a violation of copyrights are examined. Within this work, legality of the popular arguments of defence in the public against any legal action taken for the protection of copyrights, i.e. non-commercial use of the copyrighted work and the notice and takedown principle should be followed, are also put to test before the LIAW.…
