Treaties for the protection and promotion of investments, concluded by and between states, clearly demonstrate the international dimension of investment law. The content of international investment treaties is of great importance for the settlement of disputes that may arise between the parties to the treaty. In practice, the purpose of these treaties is to encourage international investments by introducing some framework provisions. Treaty provisions are drafted in relation to reciprocal investments before a dispute arises, and a settlement mechanism to be applied in the event of a dispute is agreed upon in advance. Hence, the reflection of the treaty provisions on the concrete events or matters occurs at a later stage. There are certain usages in treaty provisions which have become customary to be expressed in general terms without clear delineation of their boundaries.
