Özet

Günümüzde spor, artık yalnızca bir serbest zaman geçirme aktivitesi olarak görülmemekte ve dünyadaki en büyük piyasalardan bir tanesi konumundadır. Bu gelişmenin doğal bir sonucu olarak da çeşitli aktörlerce sporun farklı yönlerini ilgilendiren pek çok sözleşme yapılmakta ve bu sözleşmeler her geçen gün daha fazla sınır aşan nitelik taşımaktadır. Bu durum ise bu sözleşmelerin hangi hukuka tabi olacağı sorununu beraberinde getirmektedir. Bununla beraber, spora ilişkin sözleşmelerin tabi olacağı kurallar tespit edilirken, sporun kendine has yapısının da muhakkak göz önünde bulundurulması gerekmektedir. Bu düşünceye koşut olarak, her geçen gün spora ilişkin temel ilke ve kuralların lex sportiva adı verilen bağımsız bir hukuk dalı oluşturduğu yönündeki düşünce güçlenmektedir. Milletlerarası özel hukuk bakımından önem taşıyan bir sorun ise yabancılık unsuru içeren spora ilişkin sözleşmelere uygulanacak hukuk olarak lex sportiva’nın seçilmesinin mümkün olup olmayacağıdır. Bu çalışmamızda da öncelikle lex sportiva kavramını ele alınacak, akabinde ise söz konusu soruya cevap aranacaktır.…

In the twenty first century, sport is no longer a mere pastime activity, but is also among the biggest markets in the world. As a consequence of this development, various contracts are nowadays being concluded between different actors of the world of sport and these contracts increasingly have transnational features. This leads to the problem of determining the applicable law for these contracts. Nonetheless, in determining the rules to be applied for contracts related to sport, it is of utmost importance to take into account the specificity of sport. In parallel, the idea, according to which main principals and rules related to sport constitute an independent field of law called lex sportiva, is becoming increasingly stronger. A question arising with regards to private international law is that whether lex sportiva can be selected as the applicable law for contracts related to sport carrying an international element. In our study, we will first try to examine the notion of lex sportiva and afterwards try to find an answer to said question.…
