Every player steps onto a sports field having consented to a certain degree of deliberate and reckless infliction of physical and mental harm. On the other hand, this doesn’t mean that there is an immunity with regards to every single conduct during a sports match. Criminal law has always kept its distance from professional sports due to several setbacks deriving from mostly fans, prosecutors, judges and the players themselves. Some organizations cherish the rise of violence in sports as a means for viewer turnout. Some players view it as a way for gaining advantage on the field. The tide is however changing and the perception of “consent” in sports is being revisited. In this study, first, I will introduce the leading concept of consent in relation to sports and criminal law. Then, I will provide the hesitancy to implement criminal law into sports deriving from different approaches of the industry, the players and the fans. Finally I will share and contemplate on case-law from different jurisdictions to provide a perspective on what the future holds for the delicate balance between criminal law and sports.…
