İşbu Protokolü imza eden, Avrupa Konseyi Üyesi Devletler, 4 Kasım 1950 tarihinde Roma’da imzalanmış bulunan İnsan Haklarını ve Ana Hürriyetleri Koruma Sözleşmesinin (İlerde «Sözleşme» denilecektir), Avrupa İnsan Hakları Komisyonunun çalışma usulüne müteallik bazı hükümlerinin değiştirilmesini uygun görerek,
Aşağıdaki hususlarda mutabık kalmışlardır:
1. Sözleşmenin 29 uncu maddesi kaldırılmıştır.
2. Aşağıdaki hüküm Sözleşmeye ilâve edilmiştir:
«Madde 29
25 inci madde uyarınca yapılan bir müracaatı kabul ettikten sonra, inceleme sırasında, 27 nci maddede öngörülen kabul edilmezlik sebeplerinden birinin mevcudiyetini müşahede ederse, Komisyon bu talebin reddine oybirliğiyle karar verebilir.
O takdirde, karar taraflara tebliğ olunur.
Sözleşmenin 30 uncu maddesindeki «Tali Komisyon» kelimesi yerine «Komisyon» kelimesi ikame edilmiştir.
1. Sözleşmenin 34 üncü maddesinin baş tarafına aşağıdaki ibare eklenmiştir.
«29 uncu madde hükümleri mahfuz kalmak şartiyle,»
2. Aynı maddenin sonunda yazılı bulunan, «Tali Komisyon kararları üyelerin çoğunluğuyla alınır» cümlesi kaldırılmıştır.
1. İşbu Protokol, Sözleşmeyi imzalamış olan Avrupa Konseyi üyesi Devletlerin imzasına açılmış olup, bunlar:
a) Onay veya kabul ihtirazî kaydı ileri sürülmeden imzalamakla;
b) Onay veya kabul ihtirazî kaydına muallâk olarak imzaladıktan sonra onaylamak veya kabul etmekle,
Protokole Taraf olabilirler.
Onay veya kabul belgeleri Avrupa Konseyi Genel Sekreterliğine tevdi edilecektir.
2. İşbu Protokol, bu maddenin 1 numaralı bendi hükümleri uyarınca Sözleşmeye Taraf olan bütün Devletlerin Taraf olmalarını müteakiben yürürlüğe girecektir.
3. Avrupa Konseyi Genel Sekreteri:
a) Onay veya kabul ihtirazî kaydı olmadan;
b) Onay veya kabul ihtirazî kaydına muallâk olarak bütün imzalamaları;
c) Bütün onay veya kabul belgelerinin tevdiini;
d) Bu maddenin 2 numaralı bendi hükümleri gereğince işbu Protokolün yürürlüğe gireceği tarihi;
Konsey üyesi Devlete bildirecektir.
Yukarıdaki hükümleri onaylama zımnında gereği gibi, yetkili kılınmış aşağıda imzalan bulunanlar, işbu Sözleşmeyi imzalamışlardır.
Avrupa Konseyi arşivlerinde saklanacak olan işbu, Protokol, Fransızca ve İngilizce dillerinde ve her iki metin aynı derecede geçerli olmak üzere, tek nüsha halinde, 6 Mayıs 1983 tarihinde, Strasburg’da tanzim edilmiştir. Genel Sekreter mümzi Devletlerin her birine bu Protokolün aslına uygun örneklerini tevdi edecektir.

to the Convention for the Protection of Human Rights and Fundamental Freedoms, amending Artıcle 29, 30 and 34 of the Convention
The member States of the Council of Europe, signatories to this Protocol,
Considering that it is advisable to amend certain provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4 th November 1950 (hereinafter referred to as the «Convention») concerning the procedure of the European Commission of Human Rights,
Have agreed as follows:
1. Article 29 of the Convention is deleted.
2. The following provision shall be inserted in the Convention:
«Article 29
After it has accepted a petition submitted under Article 25, the Comsission may nevertheless decide unanimously to reject the petition if, in the course of its examination, it finds that the existence of one of the grounds for non-acceptence provided for in Article 27 has been established.
In such a case, the decision shall be communicated to the parties.»
In Article 30 of the Convention, the word «Sub-Commission» shall be replaced by the word «Commission».
1. At the beginning of Article 34 of the Convention, the following shall be inserted:
"Subject to the provisions of Article 29..."
2. At the end of the same Article, the sentence "the Sub-Commission shall take its decisions by a majority of its members" shall be deleted.
1. This Protocol shall be open to signature by the member States of the Council of Europe signatories to the
Convention, who may become Parties to it either by:
a. signature without reservation in respect of ratification or acceptance, or
b. signature with reservation in respect of ratification or acceptance, followed by ratification or
acceptance.
Instruments of ratification or acceptance shall be deposited with the Secretary General of the Council of
Europe.
2. This Protocol shall enter into force as soon as all States Parties to the Convention shall have become
Parties to the Protocol, in accordance with the provisions of paragraph 1 of this Article.
3. The Secretary General of the Council of Europe shall notify the member States of the Council of:
